Burglary is defined in Penal Code Section 459.  Whenever anyone enters any dwelling or building belonging to another with intent to commit a theft, he or she may be prosecuted for Burglary.  Section 460 of the Penal Code goes on to state that a burglary of a home is First Degree Burglary.  Burglary of any other type of building or enclosure, a vehicle for example, is Second Degree Burglary.  First Degree Burglary, when a person is present in the dwelling burglarized, can be a Strike pursuant to the California Three Strikes Law.
