Law enforcement and local prosecutors use scientific evidence in the form of Blood and Breath tests as evidence to convict individuals in DUI cases.  Blood and breath alcohol tests are administered when an individual is suspected of driving under the influence of alcohol. These tests assist law enforcement in determining how much alcohol is in the person’s blood.

It is imperative to be aware that these tests provide an analysis of a person’s Blood Alcohol Concentration (BAC) at the time the test was administered.  Often times, there exists a disparity between the time a person was actually driving and the time the breath or blood test was administered which could lead to unreliable results of a person’s BAC at the time of driving.

Any inaccuracy in BAC testing may change the outcome of a DUI case.  The DUI lawyers of Gurovich, Berk & Associates will always investigate the results of the BAC test and the law enforcement personnel who administered the tests.  When a person submitted to a blood test, our DUI lawyers will order a blood split and re-test the blood sample at a laboratory of our choosing, not that of the arresting law enforcement agency.  Should our DUI attorneys find any error with any aspect of the chemical testing process, such evidence will be presented and used vigorously to either reduce the charges or dismiss the case in its entirety.
