A DUI case can be initiated for driving while under the influence of a drug.  It does not matter whether the drug has been prescribed or it was illegally obtained.  If you are found to be under the influence of a drug to the point where you are not able to safely operate a motor vehicle, you will be charged with a DUI involving drugs.

The prosecution has the burden of proving the following:

You were driving, and while operating the motor vehicle, you were intoxicated to the point that you were unable to operate a vehicle safely.

If you exhibit signs of intoxication, the police officer will attempt to conduct a series of Field Sobriety Tests (FST’s).  Depending on your performance on the FST’s and any physical signs of intoxication (such as slurred speech and bloodshot eyes), you will be asked to submit to a breath test. If the breath test result indicates a 0.0% of alcohol, the police officers may suspect that you could be under the influence of controlled substances such as cocaine, ecstasy, marijuana, LSD, methamphetamine, and/or other prescribed medications.
