Penal Code Section 261 et. seq. deals with Rape.  This is the act of sexual intercourse where the victim was incapable of resisting due to a mental disorder, being incapacitated, drunk, under the influence of a drug, unconscious, asleep, under duress or threat and other similar circumstances.  A type of rape is Statutory Rape.  Here the law presumes that the victim could not have formed the requisite mindset for consent because he or she was under the age of 18, i.e. a minor.  The punishment for these acts is severe. 

Sodomy is the contact of one’s penis with another’s anus and there is even slight penetration.  This act is considered illegal if performed with a minor, against someone’s will, while someone is unconscious, while the other person is mentally impaired, and the list goes on.  This act is defined in Penal Code Section 286.  These cases have life altering consequences.  If convicted, a person faces a significant commitment in County Jail or State Prison along with a life-long Sex Offender Registration requirement (Penal Code Section 290).
